The responsible for the processing of your Personal Data is INVERSIONES MAR Y PLAYA S.A.S identified with NIT 901127909-4 with address in Cartagena de Indias, Colombia, under the brand name ÉTEKA BEACH CARTAGENA.

2. Data collected

We obtain your Personal Data when you provide it to us in person, by telephone, by electronic means, through our video-surveillance cameras, and through any other source provided for and permitted by law.

The Data we collect are: first and last name, personal address, personal telephone number, personal e-mail, copy of your official identification, number of the above mentioned official identification, nationality and credit or debit card number.

We do not collect data that reveals things that could give rise to discrimination, such as race or ethnicity, health status, genetic information, religious, philosophical and moral beliefs, trade union membership, political opinions, or sexual preference (“Sensitive Personal Data”).

3. Objectives

The Personal Data obtained is processed for the following purposes:

Identify you as a customer and provide you with the service you need and request.
Evaluate and improve the way we deliver our services.
Charge for our services.
The images and sounds captured by the video-surveillance cameras will be used for your safety, that of the people who visit us and that of our team.
Provide your Personal Data to INVERSIONES MAR Y PLAYA S.A.S. in order to be contacted before or after your stay.
Similar purposes, related and compatible with the above, in accordance with the Law.

You will have a period of five (5) days to express your refusal for the processing of your Personal Data for purposes that are not necessary, nor gave rise to the legal relationship.

4. Data transfer

Your Personal Data will not be transferred, except with your express consent. Notwithstanding the foregoing, we may transfer your Data, even without your consent, in the cases provided for by the Law, the Regulations, and the Guidelines.

5. Data Protection

The protection of Personal Data is guaranteed and they are protected by administrative, technical, and physical security measures to prevent their loss, alteration, destruction, use, access, or improper disclosure.

6. Rights

You have the right to request access, rectification, cancellation and opposition to the processing of your Personal Data. In addition, you have the right to request the revocation of the consent granted and the limitation of the use of the Personal Data. To exercise your rights, you must send an email to comercial@etekacartagena.com so that we can send you a request form, which you must fill out and send to us by the same electronic means.

For security reasons and in accordance with the Law, it is mandatory that all requests be accompanied by the information that allows us to verify the identity of the applicant and, if applicable, his legal representative. Consequently, your request must be accompanied by the following documentation:

Application form duly completed and signed.
Simple copy of the holder’s identification.
In case of acting through a legal representative, authenticated copy of the power of attorney of the legal representative and authenticated copy of the representative’s identification.
Address, telephone, and e-mail.
Acceptance or refusal to be notified via e-mail.
Clear and precise description of the Personal Data with respect to which you wish to exercise your Rights.
If applicable, indicate specifically which data should be corrected and how it should be read correctly.
If applicable, express manifestation to revoke the consent to the processing of your Personal Data.
Any other information that allows us to identify your Personal Information.

Please be advised that we maintain a record of all requests submitted. Also, in case the application submitted is incomplete, we have the right to request the missing information from you.

The applicant guarantees that the Personal Data provided is accurate, complete and true. Consequently, the applicant is responsible for any damages caused by misrepresentation or impersonation.

We will process your requests in the manner and time established in the Law and its Regulations. We are committed to respond no later than 30 (thirty) business days from receipt of the Request. This period may be extended for up to another 30 (thirty) business days as long as there is a justified cause and the holder is notified.

In case you request access to your Personal Data, they will be provided to you electronically. If expressly requested, they will be sent to your home address in a simple copy.

7. Consent

You have the right to revoke your consent to the processing of your Personal Data. The procedure, requirements, and contact information to revoke your consent will be the same as the procedure established above to exercise your rights.

If you do not express your opposition in the terms indicated in this Notice, it will be understood that you have given your consent to do so.

8. Digital media

Please be informed that we do not collect Personal Data through our website. When you visit our offices, you are video-recorded by our security cameras.
